A stagehand has sued Katy Perry, Live Nation and several other stage production companies for an undisclosed sum after a backstage accident and injury led to a toe amputation.
Employee Christina Fish alleges in the amputation lawsuit that she lost her toe during an accident while working on Katy Perry’s World Tour stop in Raleigh, North Carolina in 2014. Fish was requested to move a wall that ultimately became stuck and rolled across her foot requiring a full toe amputation.
Fish claims in the amputation lawsuit that she could feel her shoe filling up with blood but no one offered to call an ambulance, forcing her to call a friend to take her to the hospital. Shortly after, her toe turned black and gangrenous.
Fish alleges in the amputation lawsuit that doctors requested that she keep the dead toe on as long as possible before having it amputated, which ultimately caused her emotional distress and the inability to use her foot for several months because of the extent of the injury. She is no longer able to practice yoga, something that was a big part of her life. Any catastrophic personal injury that requires amputation or other severe medical response can have a significant impact on the victim’s life.
Fish claims that at the scene of the accident, other crew members offered to help her ice the injury but did not recognize the severity of the roll over accident.
Research published in the American Journal of Surgery found that the vast majority of amputations are caused by blunt trauma.
More than 80 percent of the 8,910 amputuees included in the study suffered blunt trauma injuries caused by car or machinery accidents. For car accident victims, upper body limbs were the most common to be amputated. For pedestrians and motorcyclists, however, amputation of the lower limbs was more common.
No matter how the catastrophic personal injury happens, amputees are left to cope with major physical limitations and may require adaptive devices or prosthetics on a daily basis.
Amputations may also occur because medical treatment was not provided in time, and any amputation patient faces risk of post-procedure problems like infection and other complications. Even with a successful amputation of the affected limb, recovery can take time and limit the victim’s day-to-day life.
If a person or company is responsible for causing injuries that lead to amputation, that liable party may be held accountable in court for pain and suffering, medical expenses, and other damages tied to the injury. An amputation can have a significant impact on someone’s ability to move on with their life and may limit their physical ability and ability to return to work.
If you or someone you know has been seriously injured in an accident that ultimately required amputation, you may have grounds to recover compensation through filing an amputation lawsuit or catastrophic personal injury lawsuit. The California personal injury lawyers at Bradley/Grombacher have a track record of comprehensively evaluating these claims and putting together compelling arguments in court in an effort to help you recover compensation in settlement or trial.
